“The rule of law is the foundational framework for a society where power is wielded – not arbitrarily, but with accountability and predictability.”

~Mark Dreyfus MP Attorney General of Australia – “Strong and Prosperous Democracies: the Importance of the Rule of Law Port Moresby”, 18 June 2024~

Mr Dreyfus rather than preaching #RuleOfLaw to our Pacific neighbours, perhaps first you should look a little closer to home.

The ACT is a creation of the Commonwealth is it not ??

Could you please advise how the following factual scenario conforms to your own definition of the #RuleOfLaw …“where power is wielded – not arbitrarily, but with accountability and predictability.”

The ACT Solicitor General advised a racist ACT government employee how to evade ACT and Commonwealth law and hide that crime behind a public interest disclosure.

The Solicitor General was well aware that the government employee he assisted was engaged in a campaign of racial intimidation and discrimination against his Indigenous line manager.

The same Solicitor General ought to have known the material in the aforementioned public interest disclosure directly contradicted an earlier document the said government employee created in an unsuccessful attempt to have his Indigenous line manager sacked.

The same Solicitor General progressed the aforementioned public interest disclosure as if it were factual when he ought have known that it was false.

Racism is not a victimless crime.

Fast forward to 2013. I made an application to ACAT for certain departments that the Commonwealth Ombudsman had previously confirmed were held by CMTEDD.

Rather than producing the document I was seeking, the same Solicitor General had tendered to ACAT a document that he ought to have known was false.

He instructed a barrister, despite ACAT being designed as a low cost self representation tribunal.

My original ACAT affidavit mysteriously disappeared from the ACAT Registry.

The same Solicitor General referred a fake affidavit to the AFP. I was charged on 16 counts of fraud by the AFP, based on the fake affidavit provided by the same Solicitor General. The AFP lost to me 16-0 in the ACT Supreme Court in 2017.

The AFP ran with a false narrative supplied by the same Solicitor General.

The AFP unsuccessfully tried to have multiple false documents tendered into evidence, which were provided to them by the same Solicitor General.

Multiple past and present ACT government employees lied on oath without consequence.

My defence cost me over $500K.

There was a two year period between being charged and standing trial, during which I suffered irreparable physical , psychological and financial harm.

The same Solicitor General has used his official position to avoid legal accountability for both himself and the other ACT government employees who lied on oath.

@MarkDreyfusKCMP
is this what you call adherence to the rule of law.

To date the ACAT Registrar and the ACT Attorney General have failed to respond to my FOI requests.

Justice?
