
Tu Pham investigated herself when she had a vested interest in finding that she had done nothing wrong. She abused her position as Chief Executive of ACT Treasury to sack a subordinate who had commenced legal action against her for racism. She manipulated her position to destroy the life of her Indigenous employee to avoid being taken to the Human Rights Commission. She knew that she would be unable to explain why she failed to address Angel Marina’s racism following his letter of 9 May 2002. Pham had a legal obligation to provide a safe workplace and there would have been potential criminal implications that flowed from her inaction. She clearly did not want to be cross examined in the Federal Court about her relationship with Angel Marina by an experienced barrister.
