    My mother has known Bakchos since they were at university together. They reconnected about 15 years ago over a shared interest. Bakchos has been a family friend since then. I saw firsthand the damage the lies and false testimony from Peter Garrisson, Angel Marina, Tu Pham and the Australian Federal Police did to him. It’s disgusting, and I will never have respect for the police again.

    IT SHOULD NOT BE A CRIME TO BE BORN INDIGENOUS!

    The real criminals in this are those in the Australian Federal Police who knowingly prosecuted an innocent man while knowingly using false and forged evidence provided by the ACT Solicitor General!

  2. I met Bakchos at a music festival in Germany when we were 18. We’ve known each other most of our lives. I was an early member of the Blak and Black team. One of the reasons that these issues are so intractable is that the “white” powers that be in the ACT Government and the Australian Federal Police were as nasty as they possibly could be to Bakchos and his extended family. Now they have nothing to negotiate with, but might not have realised that these matters are not simply going to fade to grey. Someway, somehow there will be legal consequences for all those involved, regardless of who they are.

    I currently live in Canberra with my wife and children. I met both Bakchos and the Faceless Freedom Fighter at the same music festival in Germany, we’ve been solid friends since we first met. I agree with the Faceless one, the issues around have become intractable because of the racism that informed many of the decisions made by both the ACT Government and the Australian Federal Police. My understanding is that former ACT Treasurer and Police Minister Ted Quinlan instructed the AFP to put the boot into Bakchos and his family as hard as they could. Australia’s self proclaimed human rights champion Jon Stanhope didn’t lift a finger to ensure that Quinlan and the AFP conducted themselves in a professional and non racist manner. Quinlan and Angel Marina were associates outside of the work environment through Sports ACT. Quinlan is also allegedly connected to the ACT Labor, Marrickville Labor, Sydney brothel, money laundering scheme.     The oinks are racists that is the simple reality. They treated my cuz Bakchos, and family with outrageous contempt. They did it to protect an irrelevant white man who is desperately seeking relevance. If you read his wiki page it’s “I was the first Raider to do this”, “I was the first raider to do that”. All of those this and that’s don’t amount to a hill of beans isn’t that right Mr Angel Marina ?

    Angel you forgot to mention on your wiki page failing first year accounting at the Canberra Institute of Technology three times, or having to leave CMTEDD under a cloud after three of your staff accused you of bullying and harassment. Convenient slips of your memory, hey ?

      Hyppolite, I’m at a total loss to understand how Angel Marina has managed to convince so many people, over such a long time, that his minuscule “accomplishments” amount to anything. The ACT must really be desperate for notable people, if they are prepared to go along with Angel Marina’s personal delusions.

    Canberra is a small place and Angel Marina has tarnished his own reputation, and the reputations of ACT Labor, the ACT Government and the Australian Federal Police with his racism, cover ups and corruption. His friends in the AFP have a lot to answer for.

    I don’t know why the ACT Government and the Australian Federal Police behaved the way they have in the matters concerning Bakchos. Putting it down to racism is too simple. I think it’s because Angel Marina managed to convince enough people in the ACT that his hallow sporting “success” was something significant, it wasn’t and never was. The last possibility is the Public Interest Disclosure the Commissioner put in, in June 2003. There are a number of people in the Australian Labor Party who stand to lose big time if the Commissioner’s PID is ever properly investigated.

    My reading of this case is that Angel Marina was nothing more than a mindless racist who was stupid enough to put his name to other people’s creations. The Labor Party weaponised the ACT legal system in an effort to hide their corruption. The problem arises when whistleblowers refuse to be silenced.

    The ACT Supreme Court case that Bakchos was forced to endure is the subject of several concerning issues that draw into question the independence of the court.

    The ACT Solicitor General Peter Garrisson welcomed Justice Mossop to the Court as it was his first case since his appointment, a function usually undertaken by the Attorney-General, at the time Gordon Ramsay. But in reality it was not Justice Mossop’s first hearing as a judge. Prior to his permanent appointment, he had been an associate judge. One must question Garrisson’s attendance in the court at all, given the complaint upon which Bakchos was prosecuted came from his office.

    Justice Mossop was asked to dismiss the case before it commenced for two reasons:
    1. the prosecution was unable to produce the original of the document on which the charges were based; and
    2. Bakchos’ lawyers were still charging for drafting an affidavit several weeks after the swearing date on the document that formed the basis of the charges. The document on which the charges were based cannot be the same document that Bakchos’ lawyers were drafting.

    Then we have the matter of how the affidavit was sworn. Bakchos’ barrister made the point that Bakchos would not swear an affidavit in the format alleged and that as he is Jewish, Bakchos would instead make an affirmation. Justice Mossop dismissed the issue, stating that it did not matter.

    In a case peppered with concerns about bias, Justice Mossop noted to the court that he had better make sure that his summation was fair. However the earlier points are viewed, this one reinforces the perception of the defence barrister that His Honour was not interested in ensuring that Bakchos had a fair trial, only that he was not appealed.

    In high dudgeon following the delivery of the 16-0 verdict by the jury in favour of Bakchos, His Honour stormed off the bench without closing the proceedings. Bakchos could not leave the court without the official release of the judge. His Honour needed to recalled to actually discharge the defendant from the court.

    Bakchos should never have been in court. The conduct of the case raises questions of impartiality and independence both of the presiding judge and casts a pall over the ACT Supreme Court.

      The matters concerning me should never have preceded to trial. The affidavit I was charged on was clearly a forgery that was created somewhere in the ACT Government and given to the Australian Federal Police by the ACT Solicitor General Peter Garrisson. Why hasn’t Garrisson been charged with using a false document?

      Then we have one of Peter Garrisson’s employed solicitors Katherine Law Jamison lying to the Supreme Court during a pre trial application. No penalty. This is a clear case of racial bias by the ACT Supreme Court.

      Tu Pham committed perjury during my trial. No action from the ACT Supreme Court. This is another clear case of racial bias by the ACT Supreme Court.

      Angel Marina lied on oath. No penalty. Another clear case of racial bias by the ACT Supreme Court.

      The AFP put false documents into evidence. No penalty. Another clear case of racial bias by the ACT Supreme Court.

      The list goes, on and on, and on…

        Bakchos don’t forget about the issues with “your signatures” you know the ones that the AFP devoted so much forensic analysis to, but don’t appear on a single document not originating from from within the ACT Government. Very strange.

    The root cause of all of these issues is Angel Marina’s racism. He has gotten away with a massive number of crimes against Bakchos and his family. Question that needs to be answered: why had Angel Marina been given immunity from prosecution for his crimes against Bakchos and his family? The only answer is entrenched and systematic racism in the ACT Government.

    I lived in Canberra in the late 1990s and early 2000s. I’m well acquainted with Angel Marina. He is a typical beta male, all noise, no substance. Thick as they come. I have no doubt that he’s a racist. I’ve read the 9 May letter multiple times. Why wasn’t he sacked after he wrote it? I’ve also read the Public Interest Disclosure from June 2003. ACT Labor should never be voted into government again.

    Bakchos has clearly been the subjected to a nasty and prolonged racist attack by multiple people, involving a Supreme Court judge who seems to have had a personal agenda that differs from that which would normally attack to a senior judge.

    This is verbatim copy and paste from the Public Interest Disclosure I went to the ACT Civil and Administrative Tribunal to get, and which the ACT Solicitor General used forged documents to have me charged by the AFP and prosecuted in an attempt to silence me. It didn’t work.

    What is in there that the Australian Labor Party and the Australian Federal Police are so concerned about that they would fit someone up in an attempt to silence them…

    “Fraud and Corruption in the ACT Public Service – The ACT Home Loan Portfolio (“HLP”)

    I refer you to paragraph 11 annexure K. In that paragraph I reference BSA and the HLP. There have been a number of ongoing issues with the HLP, not least of which is that BSA would not take over the day-to-day management of its financial transactions, unless and until, the ACT acknowledged that the HLP accounts could not be reconciled.

    In 1999 while working at DUS on the GST implementation project, I identified a number of unusual payments going from the HLP to a company styled Rosefort Pty Ltd. On making further enquiries. by way of company searches, I found that Rosefort Pty Ltd operates a brothel on Broadway in Sydney known as Kings Court. According to these searches, Kings Court is owned by Mr John Hundy. After reporting the matter to Mr Peter Wallace the Director of the GST implementation project, I made further enquiries. I refer you to annexure A, E and F which canvas to some extent the outcome of those enquiries. In short; and to avoid prejudicing any further enquiries I intend making into these issues, in my Capacity as acting Director RMB, it would appear that a large amount of money has been funneled out the HLP and transferred firstly to Kings Court where it was apparently lauded, then funneled to the Marrickville Branch of the ALP. I’m not currently in a position to discuss these matters further, as my enquiries are ongoing.”

    The Labor Party is at least as corrupt as the Liberal Party and more vicious to those it perceives as being an enemy.

      Mossop should do the people of the ACT a favour and resign. He’s an ALP appointed judge and his conduct during the trial of Bakchos was anything but professional. The whole saga has its roots in crimes committed by people associated with the ALP. All the commissioner for revenue was doing, was his job, which was to protect the revenue base of the ACT. That includes protecting it from being looted by the ALP. There is also the issue of the outstanding fraud investigation into Angel Marina, which he managed to derail. What was the little sook and whinger so worried about? As someone said in a comment on this blog, Angel Marina is a typical beta male, all hype, no substance.

    Growing up largely as an Indigenous ward of the state, we were told that if we followed the law and always did the right thing, we would be accepted as equals — just another member of the community, an equal among equals.

    Unfortunately, the reality never matched the hype. Not even close.

    The first and only Indigenous ACT Commissioner for Revenue took those words at face value. All he was doing was his job: protecting the ACT’s revenue base, including from being looted by the ALP.

    His reward for doing the right thing? He was fitted up. The ALP weaponised the entire ACT legal system against him in what can only be described as political payback.

    The Commissioner’s two real crimes?
    1. Being born Indigenous.
    2. Naively taking the “white just-us” system at face value.

    Perhaps his third crime was simple naivety — believing that honesty, duty and the rule of law would actually be rewarded.

    This whole saga has its roots in people closely associated with the ALP.

    When does the hypocrisy end?

    1. I don’t know of Justice Mossop is racist, or not, but he sure came across that way in your case. Not making any kind of judicial comment about Katherine Law Jamison lying to the Supreme Court in your pre trial application is strongly suggestive of racism. Likewise not addressing Peter Garrisson’s use of false documents to have you charged and prosecuted absolutely reeks of racism.

    Question: did Mossop simply dislike you, or does he have a problem with Indigenous people?

    If it was just you, Mossop should have recused himself, he didn’t, he should be removed from the bench.

    If he has a problem with Indigenous people, he should be removed from the bench and prosecuted.

    Mossop should stand down. Racism is never acceptable, it is absolutely unacceptable in a judge who is meant to be impartial. Clearly Mossop wasn’t impartial.
